Terms Terms Terms

Participants agree to be bound by these terms and conditions (the “Terms and Conditions”). Any information or instructions published by the Promoter about the Promotion at www.samsungbackstage.co.uk form part of the Terms and Conditions.

The Promoter

1. The Promoter is Samsung Electronics (UK) Limited, Samsung House, 1000 Hillswood Drive, Chertsey, Surrey, KT16 0PS (the “Promoter” or “Samsung”).

Promotion Period

2. The Promotion will commence at 00:01 (GMT) on 4 November 2020 and shall close at 23:59 (GMT) on 3 November 2021 (the “Promotion Period”).

Eligibility

3. To be eligible to participate in the Promotion must be a UK or ROI resident aged 18+, a registered user of Samsung Backstage and currently employed by Carphone Warehouse, Hutchinson3G, O2, EE, Vodafone, Sky, BT, Tesco, Virgin, John Lewis Partnership or DSG (each a “Channel” and together the “Channels”) (a “Participant”). For the avoidance of doubt, Participants includes Field Service Managers and Backstage Elites.



4. Employees or agents of the Promoter or anyone professionally connected to this Promotion and any group company of the Promoter is not eligible to enter.

Entry

5. All Participants must engage with and complete e-learning modules, quizzes and Newsfeed posts on Samsung Backstage. Backstage Elites Participants must additionally complete Elite training modules, competitions and Elite Chat on Samsung Backstage within the Elite section on the Samsung Backstage app (an “Entry”).

6. During the Promotion Period, Participants shall receive and have the ability to accumulate Backstage Points (the “Points”). The matrix below sets out how Points can be earned:

Prize

7. The Points earned will accumulate and be turned into ‘credits’ (the “Credits”) which can be redeemed for a variety of rewards (the “Rewards”). Participants must refer to ‘My Wallet’ for an updated list of the Rewards.

8. The Credits earned must be redeemed within twelve (12) months of earning. Once redeemed, the Credits will disappear and cannot be redeemed again. Where the Credits are not redeemed within twelve (12) months of earning, the Credits will expire and cannot be redeemed. For the avoidance of doubt, a Participant who earns Points and turns them in to Credits by 25:59 (GMT) on 5 November 2020 will have until 23:59 (GMT) on 5 November 2021 to redeem these Credits.

9. Participants will be able to accumulate and redeem further Credits within the same Promotion Period.

10. The Credits and Rewards are non‐transferable and there is no cash alternative. Samsung provides no guarantee that Rewards will remain available for selection throughout the Promotion Period. In the event of unforeseen circumstances, the Promoter may substitute a Reward of equal or greater value for the Reward.

Prize Fulfillment

11. To view their Credits and make an order, Participants must go to their ‘Wallet’ accessible from the home page or from their profile page on Samsung Backstage. Participants must then click the ‘See what’s available’ box under their available Credits to view the list of available Rewards. Participants must then select the chosen Reward and click ‘Redeem’ to complete the order (an “Order”).

12. Participants will see a confirmation message to show the Order was successful and be sent an email to their Backstage email address to confirm that their Order has been received by the Promoter and that it has been successful and validated (“Order Validation”). The email will be sent within four (4) weeks of the Order.

13. If email acknowledgement has not been received, it is the Participant’s responsibility to contact the Promoter at support@samsungbackstage.co.uk. within seven (7) days of an Order being submitted.

14. If an Order is deemed to have not been submitted correctly, the Participant will be notified via email and offered the opportunity to provide the required information within seven (7) days. If no response is received within seven (7) days of the email, then the Order shall be marked as invalid and the Participant will be no longer eligible to receive the Reward.

15. Participant Orders shall be fulfilled once a month, and will be processed on the last working day of each month.

16. The Samsung Vouchers Reward are e-vouchers which will be sent to the Participants Backstage User email address.

17. The Shopping Vouchers and Branded Merchandise Reward will be delivered by the Samsung field team to the Participants store or call centre.

18. The Taste Card Reward shall be issued via a redemption code which can be used to register with Taste Card, and the redemption code will be sent to the Backstage Users email address.

19. Participants should allow up to two (2) months from the date of all Orders for delivery (the “Fulfilment Period”).

20. If a Reward is not received within the Fulfilment Period, it is the Participants responsibility to contact the Promoter at support@samsungbackstage.co.uk. within seven (7) days of the end of Fulfilment Period. If a Participant fails to notify the Promoter within this time, an additional Reward will not be sent.

Privacy and Data Protection

21. Other than as set out in these Terms and Conditions or for the purposes of operating the Promotion, the details and information provided by the Participant when entering the Promotion or claiming the Reward will not be used for any promotional purpose, nor shall they be passed to any third party.

22. The Participant may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the Promoter’s privacy policy, available at www.samsung.com/uk/info/privacy.

General

23. The Promoter shall not be liable for any interruption to the Promotion whether due to force majeure or other factors beyond the Promoter’s control.

24. The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the Terms and Conditions of the Promotion.

25. The Promoter will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or Claim or Rewards; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Promotion.

26. Participants will be solely responsible for any and all applicable taxes and any other relevant costs, expenses which are not stated in the Terms and Conditions as being included.

27. By participating in this Promotion, you agree, to the maximum extent permitted by applicable laws, to release and hold the Promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Promotion, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the Reward. The above limitation of liability shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of Promoter’s negligence.

28. The Promotion is governed by English law.

This legal notice (these Terms) applies to the entire contents of our website under the domain name www.samsung.com/uk/ (our website) and to any correspondence between you and us (as defined in clause 1.3 below), save that our Customer Terms and Conditions of Sale apply to your orders for and our supply of products listed on the online store part of our website. Please read these Terms carefully before using our website. Using our website indicates that you accept these Terms regardless of whether or not you choose to register your information with us. If you do not accept these Terms, do not use our website.

    2. You may access our website without registering your details with us. We may revise these Terms at our sole and absolute discretion and without prior notice from time to time. You should therefore check our website from time to time to review these Terms, because, by accessing and continuing to use our website, you will be deemed to have accepted that you are bound by these Terms appearing on our website at the time of your access. Certain of these Terms may, however, be superseded by expressly designated legal notices or terms located on particular pages within our website.

    4. Our website is aimed at UK residents and intended for access and use by UK residents only. In particular, no warranties and/or representations of any kind, express or implied, are given as to the compliance of the information shown on our website or any information relating to our business in any respect with any laws of any other country.

  2. Intellectual Property and Licence

    1. You are permitted to print and download extracts from our website for your own personal, non-commercial use on the following basis: (a) no documents or related graphics on our website are modified in any way; (b) no graphics on our website are used separately from the corresponding text; and (c) our copyright and trade mark notices and the provisions of this clause 2 appear in all copies.

    2. Unless otherwise stated, the copyright, trademarks, database rights and other intellectual property rights in all software, source code and other content and material on our website (including without limitation photographs and graphical images) are proprietary rights owned by us or our licensors. For the purposes of these Terms, any use of extracts from our website other than in accordance with clause 2.1 above for any purpose is prohibited. If you breach any of these Terms, your permission to use our website automatically terminates and you must immediately destroy any downloaded or printed extracts from our website.

    4. Any rights not expressly granted in these Terms are reserved.

    5. Our website may not be used in connection with any other commercial purpose except those that are specifically endorsed or approved by us. Appropriate legal action will be taken by us for any illegal or unauthorised use of our website.

  3. Privacy and Registration

    1. Our use of your personal information is governed by our Privacy Policy which can be viewed on the footer of our website's homepage.  PLEASE READ THE PRIVACY POLICY CAREFULLY - it deals with your rights and our obligations in relation to your personal data, including what we can do with it and to whom we may give it in certain situations.

    2. We use cookies for certain areas of our website. Cookies are files that store information on your hard drive or browser and enable us to adapt this website to suit your demands and provide you with a more customised user experience. Each account and registration (for the purchase of goods or services, of a Samsung product and of your wish to be contacted by Samsung or not) effected via our website is for a single user only. Where any username and password is allocated to you, we do not permit you to share your username and password with any other person nor with multiple users on a network.     1. Other than personally identifiable information, which is covered under our Privacy Policy, any material you transmit or post to our website shall be considered non-confidential and non-proprietary. We shall have no obligations with respect to such material.     1. We do not guarantee, represent or warrant that your use of our website will be uninterrupted or error-free. While we endeavour to ensure that our website is normally available 24 hours a day, we shall not be liable if for any reason our website is unavailable at any time or for any period. Access to our website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

    2. You expressly agree that your use of, or inability to use, our website is at your sole risk.   8. General

    These Terms are between you and us and are governed by and shall be construed in accordance with the laws of England and Wales. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.

    No failure to exercise or any delay in exercising any right under these Terms shall impair or operate as a waiver thereof in whole or in part. No single or partial exercise of any right under these Terms shall prevent any further or other exercise thereof or the exercise of any other right.

    You agree that we may sub-contract the performance of any of our obligations or may assign this agreement or any of our rights or obligations hereunder without giving you notice. We will not be liable to you for any breach of these Terms which arises because of any circumstances that we cannot reasonably be expected to control. The Contracts (Rights of Third Parties) Act 1999 does not apply to the agreement between you and us formed by these Terms. These Terms form the entire understanding between you and us concerning your use of our website and supersede all previous agreements relating to our website. If any part of these Terms is determined to be legally invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms shall continue in effect.

This Privacy Notice is supplemental to the general Samsung privacy policy (which can be found at www.samsung.com/uk/info/privacy and explains the privacy practices of Samsung Electronics (UK) Limited, a company incorporated under the laws of England and headquartered at Samsung House, 1000 Hillswood Drive, Chertsey, Surrey KT16 0PS (together “Samsung”, “we”, “us”, “our”) with respect to the information collected through the Samsung Backstage portal.

This Privacy Notice provides details about how your personal information will be collected, used, shared, and stored in connection with the use of the Samsung Backstage.

In case of any inconsistency or conflict between the terms of this Privacy Notice and the general Samsung Privacy Policy, the terms of this Privacy Notice shall prevail.

Samsung Electronics (UK) Limited is the data controller for the processing of personal data.

What types of information will Samsung collect about you?

When you use the Samsung Backstage service, we will collect the following categories of information, relating to users of Samsung Backstage:

  • Name
  • Email address
  • Year of birth
  • Channel and store name
  • Employee ID number
  • Photographs
  • How is the collected information used?

    Samsung will use the collected information described above for the following purposes:

  • Operation of the Backstage platform
  • Maintenance of the Backstage platform
  • Fulfilment of promotions run through the Backstage platform
  • Sending targeted communications to Backstage users (for example in relation to a Samsung product launch)

  • Samsung’s legal basis to process personal data includes processing that is: necessary for the performance of the contract between you and Samsung (for example, to provide you with services and to identify and authenticate you so you may use certain services); necessary to comply with legal requirements (for example, to comply with applicable accounting rules and to make mandatory disclosures to law enforcement); necessary for Samsung’s legitimate interests (for example, to manage our relationship with you and to improve the services); and based on obtaining your separate consent (for example, to communicate with you about our products and services and provide you with marketing information), which may subsequently be withdrawn at any time by contacting us as specified in the How to Contact Us section of this Privacy Notice without affecting the lawfulness of processing based on consent before its withdrawal.

    How can you delete information obtained by Samsung?

    Information collected and processed by Samsung will be deleted when you delete your Samsung Backstage account. You also may request the deletion of data that has been collected by Samsung at any time by contacting us as specified in the How to Contact Us section of this Privacy Notice.

    To whom do we disclose your personal information?

    We may disclose your information internally within our business to the relevant teams such as, without limitation, the customer services team, the legal team, and where you have chosen to receive marketing messages, the marketing teams. We may also disclose your data to third party service providers which Samsung uses to assist in the hosting, operation and maintenance of the Samsung Backstage portal. We will not disclose your information to third parties for their own independent marketing or business purposes without your separate consent.

    How We Protect Your Personal Information

    We maintain administrative, technical, and physical safeguards designed to protect the personal information we obtain through Samsung against unlawful or unauthorised destruction, interference, loss, alteration, access, disclosure, or use. However, please note that despite our reasonable efforts to protect your information, no system or wireless connection is completely secure.

    International Data Transfer

    Your use of Samsung Corporate Health may involve the transfer, storage, and processing of your information outside of your country of residence, consistent with this policy. Such countries may include, without limitation, the Republic of Korea, the United States of America, and Japan. Please note that the data protection and other laws of countries to which your information may be transferred might not be as comprehensive as those in your country. We will take appropriate measures, in compliance with applicable law, to ensure that your personal information remains protected. A copy of these clauses can be obtained by contacting us as specified in the How to Contact Us section of this Privacy Notice.

    Retention of Personal Data

    We take appropriate steps to ensure that information about you is only retained based on the following logic:

  • at least the duration for which the information is used to provide you with the Samsung Samsung Backstage service (if you are inactive for more than 18 months, we will automatically delete any personal data we hold on you);
  • as required under law, a contract, or with regard to our statutory obligations; or
  • only for as long as is necessary for the purpose for which it was collected, is processed, or longer if required under any contract, by applicable law, or for statistical purposes, subject to appropriate safeguards.
  • Your Rights and Choices

    You are entitled, in accordance with applicable law, to object to or request restriction of the processing of your personal information, to exercise your right of data portability and to request access to, rectification, or removal of your own personal information.

    Please note, however, that if you decline to allow Samsung to collect or share certain information, you may not be able to use all of the features available through Samsung Backstage.

    You may also lodge a complaint with a supervisory authority if you consider that our processing of your personal data infringes applicable law.

    Prize

    7. The Points earned will accumulate and be turned into ‘credits’ (the “Credits”) which can be redeemed for a variety of rewards (the “Rewards”). Participants must refer to ‘My Wallet’ for an updated list of the Rewards.

    8. The Credits earned must be redeemed within twelve (12) months of earning. Once redeemed, the Credits will disappear and cannot be redeemed again. Where the Credits are not redeemed within twelve (12) months of earning, the Credits will expire and cannot be redeemed. For the avoidance of doubt, a Participant who earns Points and turns them in to Credits by 25:59 (GMT) on 5 November 2020 will have until 23:59 (GMT) on 5 November 2021 to redeem these Credits.

    9. Participants will be able to accumulate and redeem further Credits within the same Promotion Period.

    10. The Credits and Rewards are non‐transferable and there is no cash alternative. Samsung provides no guarantee that Rewards will remain available for selection throughout the Promotion Period. In the event of unforeseen circumstances, the Promoter may substitute a Reward of equal or greater value for the Reward.

    Prize Fulfillment

    11. To view their Credits and make an order, Participants must go to their ‘Wallet’ accessible from the home page or from their profile page on Samsung Backstage. Participants must then click the ‘See what’s available’ box under their available Credits to view the list of available Rewards. Participants must then select the chosen Reward and click ‘Redeem’ to complete the order (an “Order”).

    12. Participants will see a confirmation message to show the Order was successful and be sent an email to their Backstage email address to confirm that their Order has been received by the Promoter and that it has been successful and validated (“Order Validation”). The email will be sent within four (4) weeks of the Order.

    13. If email acknowledgement has not been received, it is the Participant’s responsibility to contact the Promoter at support@samsungbackstage.co.uk. within seven (7) days of an Order being submitted.

    14. If an Order is deemed to have not been submitted correctly, the Participant will be notified via email and offered the opportunity to provide the required information within seven (7) days. If no response is received within seven (7) days of the email, then the Order shall be marked as invalid and the Participant will be no longer eligible to receive the Reward.

    15. Participant Orders shall be fulfilled once a month, and will be processed on the last working day of each month.

    16. The Samsung Vouchers Reward are e-vouchers which will be sent to the Participants Backstage User email address.

    17. The Shopping Vouchers and Branded Merchandise Reward will be delivered by the Samsung field team to the Participants store or call centre.

    18. The Taste Card Reward shall be issued via a redemption code which can be used to register with Taste Card, and the redemption code will be sent to the Backstage Users email address.

    19. Participants should allow up to two (2) months from the date of all Orders for delivery (the “Fulfilment Period”).

    20. If a Reward is not received within the Fulfilment Period, it is the Participants responsibility to contact the Promoter at support@samsungbackstage.co.uk. within seven (7) days of the end of Fulfilment Period. If a Participant fails to notify the Promoter within this time, an additional Reward will not be sent.

    Privacy and Data Protection

    21. Other than as set out in these Terms and Conditions or for the purposes of operating the Promotion, the details and information provided by the Participant when entering the Promotion or claiming the Reward will not be used for any promotional purpose, nor shall they be passed to any third party.

    22. The Participant may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the Promoter’s privacy policy, available at www.samsung.com/uk/info/privacy.

    General

    23. The Promoter shall not be liable for any interruption to the Promotion whether due to force majeure or other factors beyond the Promoter’s control.

    24. The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the Terms and Conditions of the Promotion.

    25. The Promoter will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or Claim or Rewards; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Promotion.

    26. Participants will be solely responsible for any and all applicable taxes and any other relevant costs, expenses which are not stated in the Terms and Conditions as being included.

    27. By participating in this Promotion, you agree, to the maximum extent permitted by applicable laws, to release and hold the Promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Promotion, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the Reward. The above limitation of liability shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of Promoter’s negligence.

    What types of information will Samsung collect about you?

    When you use the Samsung Backstage service, we will collect the following categories of information, relating to users of Samsung Backstage:

  • How is the collected information used?

    Samsung will use the collected information described above for the following purposes:

  • Operation of the Backstage platform
  • Maintenance of the Backstage platform
  • Fulfilment of promotions run through the Backstage platform

    How can you delete information obtained by Samsung?

    Information collected and processed by Samsung will be deleted when you delete your Samsung Backstage account. You also may request the deletion of data that has been collected by Samsung at any time by contacting us as specified in the How to Contact Us section of this Privacy Notice.

    To whom do we disclose your personal information?

    We may disclose your information internally within our business to the relevant teams such as, without limitation, the customer services team, the legal team, and where you have chosen to receive marketing messages, the marketing teams. We may also disclose your data to third party service providers which Samsung uses to assist in the hosting, operation and maintenance of the Samsung Backstage portal. We will not disclose your information to third parties for their own independent marketing or business purposes without your separate consent.

    How We Protect Your Personal Information

    We maintain administrative, technical, and physical safeguards designed to protect the personal information we obtain through Samsung against unlawful or unauthorised destruction, interference, loss, alteration, access, disclosure, or use.     Your use of Samsung Corporate Health may involve the transfer, storage, and processing of your information outside of your country of residence, consistent with this policy. Such countries may include, without limitation, the Republic of Korea, the United States of America, and Japan.
